PRIVACY POLICY
This Privacy Policy applies to personal information and data collected through the Gladiator mobile application (the “App”) and any related services offered by Blackforest LLC (“Blackforest,” “we,” “us,” or “our”) (collectively, the “Services”). Blackforest is committed to protecting the privacy of users of the Services. This policy discloses our information gathering, use, and dissemination practices. Blackforest is subject to the regulatory and enforcement authority of the United States Federal Trade Commission (FTC).
1. Information Blackforest Collects
Users may access certain features of the App without providing personal information. To access full functionality, including account creation or purchasing a subscription, users may be required to provide personal information including but not limited to: name, email address, payment and billing information, and device information.
The App automatically collects certain technical data including device identifiers, operating system information, IP addresses, session data, and usage analytics to help us understand how users interact with the App.
The App allows users to manually enter racing performance data including session details, vehicle setup metrics, lap times, tire pressures, temperatures, and other performance measurements. This data is stored locally on your device and may be transmitted as part of the export and sharing features described below.
2. Purposes of Data Collection
Blackforest collects and uses information for the following purposes: to provide, maintain, and improve the Services; to process transactions and manage subscriptions; to respond to customer support inquiries; to analyze usage trends and improve App performance; to send transactional communications related to your account or subscription; to comply with legal obligations; and to enforce our Terms of Service. Aggregate and anonymized data may be used for internal analytics, product development, and business reporting. This aggregate information does not identify specific users.
3. What Blackforest Does With the Information It Collects
Blackforest may use aggregated and anonymized user information to understand usage patterns, improve the Services, and describe the Services to prospective partners or third parties. Personal information will not be sold to third parties for commercial marketing purposes without prior user consent.
Blackforest may share personal information with third-party service providers engaged to support the Services, including payment processors, analytics providers, and customer support platforms. These providers are permitted to access only the information necessary to perform their services and are required to maintain confidentiality and not use the information for any other purpose.
Personal information may also be disclosed when we believe in good faith that disclosure is reasonably necessary to: (i) comply with applicable law or legal process; (ii) enforce our Terms of Service; (iii) respond to claims that content violates the rights of third parties; (iv) protect the rights, property, or safety of Blackforest, its users, or the public; or (v) complete an audit or regulatory review. Blackforest may be required to release personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.
4. News Feed and Third-Party Content
The App includes an optional news feed feature that fetches publicly available RSS content from third-party motorsport news sources, including Motorsport.com and Racecar Engineering. When this feature is enabled, your device makes network requests to retrieve this content. Blackforest does not control, endorse, or take responsibility for the content, privacy practices, or accuracy of information provided by these third-party sources. The privacy practices of these third-party websites are not covered by this Privacy Policy. Users may disable the news feed at any time within the App’s Appearance settings.
5. Data Export and Sharing
The App includes an optional feature that allows users to export their session data as a .gladiator file and share it with other Gladiator users via email, AirDrop, or other sharing methods. Blackforest does not receive, store, or have access to files shared between users via this feature. Users are solely responsible for ensuring they share their data only with intended recipients and understand that exported files may contain personal performance information.
6. In-App Purchases and Subscriptions
The App offers optional paid subscription plans processed through Apple’s App Store. Blackforest does not directly collect or store payment card information. All payment transactions are handled by Apple in accordance with their own privacy policy and terms of service. Subscription status and entitlements are managed through Apple’s StoreKit framework.
7. Cookies and Similar Technologies
The App may use local storage, device identifiers, and similar technologies to remember user preferences, maintain session state, and improve the user experience. These technologies do not collect personal information beyond what is necessary for App functionality. Users may reset certain stored preferences through the App’s Settings menu.
8. Data Retention and Security
Racing performance data entered by users is stored locally on the user’s device. Blackforest does not maintain cloud backups of user performance data unless such a feature is explicitly offered and opted into by the user. We implement appropriate technical and organizational measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. User Options — Opt-Out and Data Access
Users may opt out of receiving promotional communications from Blackforest by following the unsubscribe procedures in any such communication or by contacting us at support@blackforestcompany.com. Users may access, correct, or request deletion of their personal account information by contacting us directly. To delete all locally stored App data, users may uninstall the App from their device.
10. Children’s Privacy
The App is not directed to children under the age of 13. Blackforest does not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided personal information, we will take steps to delete such information promptly. 11. European Union Data Protection
Blackforest complies with applicable data protection laws regarding the collection, use, and retention of personal information from European Union member countries. EU residents have the right to access, correct, or request deletion of their personal data. To exercise these rights, please contact us at support@blackforestcompany.com. In cases where personal data of EU individuals is transferred to third parties, Blackforest ensures appropriate safeguards are in place in accordance with applicable data protection requirements.
12. User Consent
By downloading and using the App, users signify their acceptance of this Privacy Policy and consent to the collection, use, and disclosure of their personal information as described herein. If a user does not agree to this policy, they should not use the App or its Services. Continued use of the App following any posted changes to this policy constitutes acceptance of those changes.
13. Changes to This Privacy Policy
Blackforest reserves the right to update or modify this Privacy Policy at any time. Any changes will be posted within the App and at www.blackforestcompany.com/privacy. We encourage users to review this policy periodically. Continued use of the App following the posting of changes constitutes acceptance of those changes.
